    Dear experts, Out of habit, I rated your previous answer with 5 stars, but I began to delve into it - I realized that it was just a reply. I asked for job descriptions for a SPECIFIC field of activity - housing and communal services (management company), and you sent me absolutely general, faceless instructions. I'm terribly disappointed, it's just that you can find something more applied on the Internet. Now I need to provide Rostekhnadzor with the Chief Engineer, and I have only nonsense like " Chief Engineer must ensure that the manufactured products comply with current state standards, technical conditions and requirements of technical aesthetics, as well as their reliability and durability. "How do you like it yourself? It seems to me that you should be ashamed to do such unprofessional work for quite a lot of money. quickly rehabilitate.It is a pity to be disappointed ...

    In conclusion, we note that the obligation to compile is established only for state bodies (). It is impossible to fine an organization that is not a government agency for the lack of instructions ().

    However, there are strong arguments in favor of writing a job description. Its presence will allow the organization:

    • justify;
    • evenly distribute responsibilities between similar positions;
    • prove in court the legitimacy of the imposition disciplinary action per employee;
    • correctly conduct personnel certification, etc.

    Job descriptions are prepared for each staff position.

    The procedure for compiling a job description not regulated by law , therefore, the employer independently decides how to draw it up. In practice, the job description can be framed as or how. Similar explanations are contained in.

    In addition, the chief engineer is a leadership position in any organization. Regardless of the type of activity of the organization, the labor function of the chief engineer is designated taking into account the Qualification Handbooks, professional standards (and the duties for this position are determined without taking into account the scope of the organization's activities). See "Qualification directory of positions of managers, specialists and other employees" (approved by Decree of the Ministry of Labor of Russia of 08/21/1998 N 37) (as amended on 02/12/2014). Also, when drawing up instructions, the real duties that the employee will perform when appointed to a particular position are taken into account. The employer draws up instructions, taking into account the provisions outlined above.

    We also draw your attention to the fact that we do not develop documents at the request of users, but offer forms of documents for the most common situations that you can easily adapt to your needs.

    Checking the effectiveness of job descriptions

    Evgeniya RIVKINA, Head of Human Resources, KORIS Assistance LLC (St. Petersburg)

    Read the article:

    A rare check of the organization does without the question: "Where are your job descriptions?". Perhaps that is why most managers believe that job descriptions are mandatory, but at the same time vaguely represent their true purpose. That's why it's so important to figure out what makes job descriptions truly effective and why they can't be written formally.

    Principles for compiling a job description

    The job description prescribes the labor function of the employee, the list of his duties, the limits of responsibility, the body of knowledge and professional experience, which he must possess, etc. (). The procedure for compiling a job description is not regulated by regulatory legal acts. This means that the employer has the right to determine the appropriate procedure himself and fix it in a local act, for example, in the Regulations on Job Descriptions or in the Instructions for HR Records Management.

    Ideally, before developing job descriptions, it is desirable to create regulations on structural divisions (). In other words, all the functions necessary for the successful operation of the organization must be prescribed and assigned to the relevant departments, and only then between employees ().

    Example

    The organization of Galaktika LLC is located in Tula, and the founders of the company are in Moscow. At the annual meeting, it seemed to the founder Konstantin K. that the accounting staff of Galaktika LLC was bloated, and he proposed to reduce the position of the payroll accountant. In reply Chief Accountant Irina N. sent the founder job descriptions of the employees of her department, including the payroll accountant (sample below). Irina N. made an addition that the payroll accountant combines her duties with the duties of a cashier, which makes it possible to reduce the wage fund. The founders had no more claims to the number of the department.

    It is widely believed that job descriptions should be created exclusively by personnel officers. However, heads of departments should also be involved in this work. They know what tasks their subordinates face, what operations each of them actually performs (essence, term, frequency), what qualifications employees should have.

    The task of the personnel officer is to develop a form of job description, to help the heads of departments correctly formulate the duties of specialists and qualification requirements for them. And also check the literacy of the document, including legal (if the organization does not have a lawyer) ().

    What to look for in the current instructions

    It is not enough to distribute labor functions among employees with the help of job descriptions. We need to ensure that these documents become really useful tools. Let's see how to do it.

    Compliance with the actual functions performed. Check to what extent the functions actually performed by employees correspond to their job descriptions. The latter should describe the list of procedures that the employee performs as part of his work (). Including the procedure for replacing other employees during their absence, the interaction of a specialist with other departments, his manager and subordinates. Make sure you follow the instructions at work. Make adjustments to them if necessary.

    Various functionality. Avoid unnecessary duplication of functions - this leads to confusion in work, unnecessary competition and conflicts between employees, which ultimately reduces work efficiency. At the same time, remember that the job responsibilities of employees who work in positions of the same name must be the same (Art. , Labor Code of the Russian Federation). Otherwise, it is better to rename their positions. Ensure that responsibilities are evenly distributed among similar positions.

    Example

    The head of the personnel department of a large trading holding convinced the commercial director to assign individual employees to each function of the sales department. Previously, each manager led the client from the beginning (cold calls) to the end (calculations and delivery of goods). However, different stages of work with a client required the manifestation of different personal qualities, so one employee physically could not perform it equally effectively. The idea was implemented and turned out to be successful. The sales department began to work as a single team, unhealthy competition between employees disappeared, the company stopped incurring losses due to the absence or dismissal of one of the managers. The problem of emotional burnout was also solved: employees could change the scope of activities within their department without wasting time on adaptation.

    The job description should not worsen the position of the employee in comparison with the norms established by labor legislation and other regulatory legal acts containing labor law norms ().

    Simple language of presentation. Instructions must be clear and not misunderstood. Instead of foreign terms with which the employee may not be familiar, use their Russian counterparts. The employee must be familiarized with the job description before signing the employment contract and find out if his functions are clear to him ().

    Compliance with the professional standard. Before the advent of professional standards, organizations, when developing job descriptions, were guided by qualification directories, many of the provisions of which were outdated (). Now you can take into account the requirements of accepted professional standards. Note that while professional standards have not become mandatory.

    Efficiency criteria. There are several options for how to encourage employees to perform their duties at the maximum level. Many organizations pay employees based on key indicators efficiency (KPI), use the principles of formation effective contract and others (Art., Labor Code of the Russian Federation). At the same time, the employment contract stipulates that the payment of a bonus or bonus part of the salary depends on the fulfillment by the employee of certain criteria that are prescribed in the relevant local act. These criteria must be measurable and objective. Traditionally, the basis for non-payment of a bonus or bonus is a violation of job description, labor discipline, etc.

    Revision frequency. As a rule, job descriptions are reviewed every five years or when there are significant changes in the work process. In the Regulations on job descriptions, it is better to indicate:
    - events that entail a revision of the job description. For example, supplementing the duties of an employee in connection with the approval of a professional standard for the position, changing staffing, new challenges structural unit, the emergence of other types of work;
    - employees who have the right to make a proposal to adjust the job description. For example, it can be the head of the department, the head of the personnel department, the lawyer of the organization.

    Job description will help out in case of a labor dispute

    Well-written job descriptions not only help the employer build relationships with the employee, but are also useful in resolving labor disputes. With the help of these documents, it is possible to justify the difference in salaries in similar positions, objectively assess the activities of an employee during the trial period, argue the dismissal of an employee due to inconsistency with the position held, etc. Employees who challenge their dismissal in court often refer precisely to the lack of job descriptions ( appeal ruling of the Perm Regional Court dated May 14, 2014 in case No. 33-4192).

    Making changes to the job description

    As new professional standards are approved, many organizations amend the job descriptions of working employees. Without their consent, this can only be done if the amendments are of a clarifying, technical nature and, in general, fall within the scope of the labor function performed by the employee. If the employee does not agree to changes to the job description, and they, in turn, affect mandatory conditions employment contract, then it is impossible to make them unilaterally (
