At present, the certification procedure teaching staff state and municipal educational institutions is established by Order of the Ministry of Education and Science of the Russian Federation of March 24, 2010 N 209 (hereinafter - Order N 209). In connection with the numerous questions that come to our editorial office about the certification of teachers, we once again recall the procedure for conducting such certification and explain the most common difficulties.

The Ministry of Education and Science issued several letters (dated August 15, 2011 N 03-515 / 59, dated August 18, 2010 N 03-52 / 46, hereinafter - Clarifications) on the procedure for attesting teachers of state and municipal institutions. Consider Order N 209 in view of these Explanations.

So, this procedure applies to teachers of state and municipal educational institutions implementing the main educational programs:

preschool education;

— primary general education;

— basic general education;

— secondary (complete) general education;

- primary vocational education;

— secondary vocational education;

- additional educational programs.

In accordance with paragraph 12 of Art. 28 of Law N 3266-1, establishing the procedure for attesting these employees refers to the powers of federal government bodies in the field of education. Thus, the state authorities of the constituent entities of the Russian Federation (local governments) are not entitled to adopt their own regulatory legal acts that establish a different procedure for attesting teachers.

For your information. State authorities of the constituent entities of the Russian Federation (local governments) can only adopt regulatory legal acts on issues related to the organization and conduct of certification, but they should not contradict Order N 209.

Order N 209 provides for two types of certification of teaching staff:

- establishing the compliance of the level of qualification with the requirements for qualification categories (first or highest);

- confirmation of compliance with the position held.

Certification to confirm the position held

Certification of this type is mandatory for teachers who do not have qualification categories (first or highest), and must be held once every five years. Due to the fact that such certification is mandatory, the basis for its implementation will be the presentation of the employer, which must contain:

— a comprehensive and objective assessment of professional, business qualities pedagogical worker;

- the results of his professional activity on the basis of the qualification characteristics for the position held;

- information about the passage of advanced training, including in the direction of the employer, for the period preceding the certification;

- information about the results of the previous certification.

Note that the employer is obliged to familiarize the employee with this submission against signature no later than a month before the certification. If the teacher disagrees with the submission, he can independently submit to the certification commission information characterizing his labor activity for the period from the date of the previous certification (for primary certification - from the date of employment), as well as an application with the appropriate justification (clause 20 of Order N 209 ).

Question: Can an employee refuse to undergo certification for compliance with the position held?

As stated in the Clarifications of the Ministry of Education and Science, a teacher cannot refuse this attestation, since it is mandatory for everyone. The only exceptions are:

- employees with a qualification category (first or highest) (clause 17 of Order No. 209);

- employees who have worked in their position for less than two years (clause 18 of Order N 209);

- pregnant women (clause 18 of Order N 209);

- women on maternity leave (clause 18 of Order No. 209);

- pedagogical workers who are on parental leave until they reach the age of three years (clause 18 of Order N 209).

For your information. Certification of employees listed in clause 18 of Order N 209 is possible no earlier than two years after they leave the specified holidays.

According to Art. 21 of the Labor Code of the Russian Federation, the employee is obliged to observe labor discipline. Refusal to pass certification of this type refers to violations of labor discipline. For committing disciplinary offense, that is, non-fulfillment or improper fulfillment by the employee through his fault of the tasks assigned to him job duties, the employer has the right to apply the following disciplinary sanctions: remark, reprimand and dismissal on appropriate grounds (Article 192 of the Labor Code of the Russian Federation).

If the employee refuses to undergo such certification, the employer must record the refusal by drawing up an appropriate act, which indicates: the place of its compilation, date, time; the position of the employee; surnames officials in whose presence the act was drawn up (at least three persons). If the employee refuses to sign the introduction of the submission, an act is again issued indicating the possible reason for the refusal, and it is also signed by the persons in whose presence it was drawn up. Employees of the Ministry of Education and Science noted that it is advisable to hand one copy of the act to the employee in respect of whom it was drawn up, making a note about it in it. Those present at the drawing up of the act should once again sign under the phrase about handing the act to the employee.

Question: How is the attestation for compliance with the position held?

According to paragraph 23 of Order N 209, based on the results of certification, the certification commission makes one of the following decisions. Worker:

- does not correspond to the position held (position is indicated).

The clarifications say that the results of this type of certification are not entered into the work book, but are drawn up in the minutes of the meeting of the certification commission, approved by an administrative act (usually in the form of an order (instruction) of the federal executive body, the executive body of the constituent entity of the Russian Federation that manages in the field of education) and are included in the attestation sheet of the person being certified.

Information about the certification of a pedagogical worker, carried out in order to confirm his compliance with the position held, is entered in his personal employee card (form T-2, approved by the Decree of the State Statistics Committee of the Russian Federation of 01/05/2004 N 1 "On approval of unified forms of primary accounting documentation for accounting for labor and its payment”, containing section IV “Attestation”).

Question: What should I do if the employee has not passed the certification for compliance with the position held?

By virtue of clause 24 of Order N 209, if the employee was found not to be appropriate for the position held due to insufficient qualifications, labor contract it can be terminated under paragraph 3 of part 1 of Art. 81 of the Labor Code of the Russian Federation. Note that dismissal on this basis is allowed only if it is impossible to transfer the employee with his written consent to another job available to the employer (as vacant position or a job corresponding to the qualification, as well as a vacant lower position or a lower paid job) that the employee can perform, taking into account his state of health. Moreover, the employer is obliged to offer all the vacancies that meet the specified requirements that he has in the given locality, and in other localities - only if this is provided for by the collective agreement, agreements, labor contract.

We add that the employees of the Ministry of Education and Science in their Clarifications drew attention to the following provisions of the Labor Code:

- it is not allowed to dismiss an employee during the period of his temporary incapacity for work and while on vacation; pregnant women, as well as women with children under the age of three, single mothers raising a child under the age of 14 (a disabled child - up to 18), other persons raising these children without a mother (Article 261 of the Labor Code of the Russian Federation) ;

- the dismissal of employees who are members of a trade union is carried out in compliance with the procedure for taking into account the reasoned opinion of the elected body of the primary trade union organization in accordance with Art. 373 of the Labor Code of the Russian Federation (part 2 of article 82 of the Labor Code of the Russian Federation).

Certification to establish compliance of the level of qualification with the requirements for the first or highest qualification category

Certification of this type is not mandatory and is carried out on the basis of the employee's application. The qualification category of a teacher established on the basis of attestation is valid for five years. Note that the timing of such certification is determined individually for each employee.

Note! A teacher has the right to apply to the attestation commission at any time before the expiration of the existing qualification category. However, at the same time, it is necessary to provide for the possibility for the commission to take into account the validity period of the qualification category previously established for the teacher when drawing up the certification schedule (which is important for maintaining the level of remuneration). That is, an application for attestation must be submitted in advance, as a rule, at least three months before the expiration of the existing qualification category. This time will be used to consider the application (one month), as well as to conduct certification, the duration of which for each teacher should not exceed two months.

Question: Is the validity of the qualification categories of pedagogical workers extended if the validity of the category ends during the periods specified in paragraph 18 of Order N 209?

The Clarifications say that there are no restrictions on the certification of employees specified in clause 18 of Order N 209 to establish the compliance of the skill level with the requirements for the first or highest qualification category. The passage of such certification in the indicated periods depends on the desire of the teaching staff themselves.

Restrictions are provided only for teachers applying for the highest qualification category, due to the fact that only those with the first qualification category can apply for it, and not earlier than two years after its establishment, and who submitted an application to the certification commission no later than the last day of validity first qualifying category.

Thus, a teacher applying for the first qualification category can apply to the certification commission at any time, including during the periods specified in clause 18 of Order N 209, or immediately after them.

Question: How is the work of pedagogical workers whose qualification category has expired while on maternity leave?

Employees of the Ministry of Education and Science noted that in this case, the educational institution may provide an additional guarantee when going to work by maintaining the level of remuneration for the previously existing qualification category in the collective agreement. This is possible, since the collective agreement, taking into account the financial and economic situation of the employer, may establish more favorable working conditions for employees than provided for by laws and other regulatory legal acts. In addition, additional social and labor guarantees can be fixed in contracts concluded at all levels. social partnership(federal, regional and local) industry agreements that will be binding on educational institutions. At the same time, sectoral agreements in force in the field of education in many constituent entities of the Russian Federation provide for teaching staff of various categories, including for those who started work after being on parental leave, maintaining the level of remuneration for a period of up to one year, taking into account the existing them in the qualification category.

Note that in accordance with paragraph 28 of Order N 209, the qualification category established on the basis of attestation for pedagogical workers is valid for five years. Qualification categories are retained when such an employee moves to another educational institution, including one located in another subject Russian Federation, during the period of their validity (clause 34 of Order N 209).

As for an employee who is on parental leave, according to clause 18 of Order N 209, certification is not subject to:

- pedagogical workers who have worked in their position for less than two years;

- pregnant women;

- women on maternity leave;

- pedagogical workers who are on parental leave until the child reaches the age of three years.

Certification of these employees is possible not earlier than two years after their release from the specified holidays.

Thus, from the above provisions of Procedure N 209 it follows that an employee who is on parental leave is not subject to certification. Her attestation is possible no earlier than two years after leaving such a vacation. This means that when a given employee enters work, her qualification category is retained, respectively, wages are calculated taking into account this category.

Question: How is certification for compliance of the qualification level with the requirements for the first or highest qualification category formalized?

By virtue of clause 32 of Order N 209, based on the results of certification, the commission makes one of the decisions:

- the level of qualification (position is indicated) meets the requirements for the first (highest) qualification category;

- the level of qualification (position is indicated) does not meet the requirements for the first (highest) qualification category.

In addition, as stated in the Explanations, information about the results of the attestation carried out on the basis of the application of a pedagogical worker to determine whether the level of his qualifications meets the requirements for the first or highest qualification categories must be entered in the work book. So, according to clause 3.1 of the Instruction, if an employee is assigned a new category (class, category, etc.) during the period of work, an appropriate record is made about this in the prescribed manner.

Features of the certification procedure for teachers

If on the day of certification the teacher could not appear for good reason, the certification procedure is postponed to another date.

Adjustments are made to the certification schedule. The employer presents the employee with a new date thirty days before it occurs.

When a teacher does not appear for certification without a good reason, the decision can be made without him. In this case, an open vote is held among the members present.

Based on the results of certification, the commission makes a decision:

Computer testing

Previously, qualification tests in the certification process were carried out in writing. The newly minted attestation procedure canceled the written survey.

At this time, certified teachers are sent to a special equipped center, where they are checked through computer testing.

Within two and a half hours, the certified worker must answer one hundred questions. The survey includes topics such as:

  • knowledge of the law;
  • fundamentals of pedagogy and psychology;
  • fundamentals of subject knowledge;
  • methods and technologies of teaching.

Each question has multiple answers, you only need to choose one. If at least sixty correct answers are received, the test is considered passed.

Otherwise, the certification result is negative. In how to score points, the teacher can rely only on his own knowledge.

A well-thought-out control system does not allow "rigging" the results. The first stage of certification confirms compliance or non-compliance with the position held.

At the second stage, there is an analytical generalization of the results of the teacher's activities and the assignment of a certain qualification.

Teachers are allowed to the second stage only with positive test results.

At the same time, only individuals whose test result was more than eighty-five percent of correct answers can apply for the highest qualification category.

If the highest category

6. The attestation commission of the organization is created by the administrative act of the employer, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission.

7. The composition of the attestation commission of the organization must include a representative of the elected body of the relevant primary trade union organization (if such a body exists).

8. Certification of teaching staff is carried out in accordance with the administrative act of the employer.

9. The employer introduces the teaching staff with the administrative act containing the list of employees of the organization subject to certification, the certification schedule, against signature at least 30 calendar days before the day of their certification according to the schedule.

10. To conduct certification for each teacher, the employer submits a submission to the certification commission of the organization.

11. The submission contains the following information about the teacher:

a) last name, first name, patronymic (if any);

b) the name of the position on the date of certification;

c) the date of conclusion of an employment contract for this position;

d) the level of education and (or) qualifications in the specialty or field of study;

e) information on obtaining additional professional education in the field of pedagogical activity;

f) the results of previous certifications (if any);

g) a motivated comprehensive and objective assessment of professional, business qualities, the results of the professional activity of a pedagogical worker in the performance of labor duties assigned to him by an employment contract.

12. The employer acquaints the teacher with the submission against signature no later than 30 calendar days before the day of the certification. After reviewing the submission, the teacher, if desired, may submit to the certification commission of the organization additional information characterizing his professional activities for the period from the date of the previous certification (for primary certification - from the date of employment).

If the teacher refuses to get acquainted with the presentation, an act is drawn up, which is signed by the employer and the persons (at least two) in whose presence the act is drawn up.

13. Certification is carried out at a meeting of the certification commission of the organization with the participation of a teacher.

The meeting of the attestation commission of the organization is considered competent if it is attended by at least two thirds of the total number of members of the attestation commission of the organization.

In the absence of a teacher on the day of the certification at a meeting of the certification commission of the organization for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the employer informs the employee against signature at least 30 calendar days before new date carrying out its certification.

If a teacher fails to appear at a meeting of the attestation commission of the organization without a good reason, the attestation commission of the organization conducts certification in his absence.

14. The attestation commission of the organization considers the submission, additional information submitted by the teacher himself, characterizing his professional activity (if presented).

15. Based on the results of the certification of a teacher, the certification commission of the organization makes one of the following decisions:

corresponds to the position held (the position of the pedagogical worker is indicated);

does not correspond to the position held (the position of the pedagogical worker is indicated).

16. The decision is made by the attestation commission of the organization in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission of the organization present at the meeting.

When passing the certification, a teacher who is a member of the certification commission of the organization does not participate in the voting on his candidacy.

17. In cases where at least half of the members of the certification commission of the organization present at the meeting voted for the decision on the compliance of the employee with the position held, the teacher is recognized as appropriate for the position held.

18. The results of the attestation of a teacher who is directly present at a meeting of the attestation commission of the organization are communicated to him after summing up the voting results.

19. The results of the certification of teachers are recorded in a protocol signed by the chairman, deputy chairman, secretary and members of the certification commission of the organization who were present at the meeting, which is stored with submissions, additional information provided by the teachers themselves, characterizing their professional activities (if any) , at the employer.

20. For a teacher who has passed certification, no later than two working days from the date of its conduct by the secretary of the certification commission of the organization, an extract from the protocol is drawn up containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the certification commission of the organization , voting results, on the decision adopted by the attestation commission of the organization. The employer acquaints the teacher with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

21. The results of certification in order to confirm the compliance of teachers with their positions on the basis of assessment and professional activity, the teacher has the right to appeal in accordance with the legislation of the Russian Federation.

22. Certification in order to confirm compliance with the position held does not pass the following teaching staff:

a) teaching staff with qualification categories;

b) who have worked in their position for less than two years in the organization in which certification is carried out;

c) pregnant women;

d) women on maternity leave;

e) persons on parental leave until the child reaches the age of three;

f) absent from the workplace for more than four consecutive months due to illness.

23. 25. Certification of pedagogical workers of organizations administered by federal executive bodies is carried out by attestation commissions formed by federal executive authorities in whose jurisdiction these organizations are, and in relation to pedagogical workers of organizations administered by a constituent entity of the Russian Federation, pedagogical workers of municipal and private organizations, this attestation is carried out by attestation commissions formed by authorized state authorities of the constituent entities of the Russian Federation (hereinafter referred to as attestation commissions) * (4) .

26. When forming attestation commissions, their composition, work regulations, as well as the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of teaching staff are determined.

27. Certification of teachers is carried out on the basis of their applications submitted directly to the certification commission, or sent by teachers to the certification commission by mail with a letter of receipt or notification in the form of an electronic document using public information and telecommunication networks, including number of the Internet.

28. In the application for certification, pedagogical workers indicate the qualification categories and positions for which they wish to be certified.

29. Applications for attestation are submitted by teaching staff, regardless of the length of work in the organization, including while on parental leave.

30. Applications for attestation in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by teachers no earlier than two years after the establishment of the first qualification category for this position.

31. The expiration of the highest qualification category does not limit the right of a teacher to subsequently apply to the certification commission with an application for his certification in order to establish the highest qualification category for the same position.

32. Applications of teachers for attestation are considered by attestation commissions within a period of not more than 30 calendar days from the date of their receipt, during which:

a) a specific term for the certification is determined for each teacher individually, taking into account the validity period of the previously established qualification category;

b) a written notification of teaching staff about the date and place of their certification is carried out.

33. The duration of certification for each teacher from the beginning of its implementation and until the decision of the certification commission is no more than 60 calendar days.

34. The meeting of the attestation commission is considered competent if it is attended by at least two thirds of the total number of its members.

35. The pedagogical worker has the right to personally be present during his certification at a meeting of the certification commission. If a teacher does not appear at a meeting of the attestation commission, attestation is carried out in his absence.

active participation in the work of methodological associations of pedagogical workers of organizations, in the development of program and methodological support of the educational process, professional competitions.

38. Evaluation of the professional activities of teachers in order to establish a qualification category is carried out by the certification commission based on the results of their work, provided for in paragraphs 36 and of this Procedure, provided that their activities are related to the relevant areas of work.

39. Based on the results of certification, the certification commission makes one of the following decisions:

establish the first (highest) qualification category (the position of the pedagogical worker for which the qualification category is established is indicated);

refuse to establish the first (highest) qualification category (the position for which the teacher is denied the establishment of a qualification category is indicated).

40. The decision of the attestation commission is made in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission present at the meeting. In case of equality of votes, the attestation commission makes a decision to establish the first (highest) qualification category.

When passing the attestation, a teacher who is a member of the attestation commission does not participate in the voting on his candidacy.

The results of the attestation of a teacher directly present at the meeting of the attestation commission are communicated to him after summing up the voting results.

41. The decision of the attestation commission is drawn up in a protocol, which is signed by the chairman, deputy chairman, secretary and members of the attestation commission who took part in the voting.

The decision of the attestation commission comes into force from the date of its issuance.

42. When making a decision of the attestation commission to refuse to establish the highest qualification category in relation to a teacher who has the first qualification category, the first qualification category is retained for him until its expiration.

43. Pedagogical workers who, during certification, were denied the establishment of a qualification category, apply at their request to the certification commission with an application for certification for the same qualification category not earlier than one year from the date the certification commission made the appropriate decision.

44. Based on the decisions of the attestation commissions on the results of attestation of pedagogical workers, the relevant federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation issue administrative acts on the establishment of pedagogical workers of the first or highest qualification category from the date of the decision of the attestation commission, which are posted on the official websites of the indicated bodies on the Internet.
