“SRO types of construction works” is a common query in search engines, however, it is sometimes difficult to find a clear list of such works due to regular legal innovations in the relevant industry. In our article, we provide, among other things, an up-to-date list of regulatory documents containing this information.
Types of work in construction requiring SRO approval: list-2018
The list of types of construction work, the performance of which requires the admission of a self-regulatory organization (hereinafter referred to as SRO), is approved by the Ministry of Regional Development of the Russian Federation.
At the moment, such a list is approved by order of the Ministry of Regional Development of the Russian Federation of December 30, 2009 No. 624 (hereinafter - Order No. 624).
IMPORTANT! Hereinafter, for simplification, we will use the phrase “SRO admission”, however, it must be understood that from 07/01/2017, as such, SRO certificates of admission to certain types of work have lost their force (Article 55.8 of the Town Planning Code of the Russian Federation, question 2 from the letter of the Ministry of Construction of Russia dated August 17, 2016 No. 26526-OS/02). From this moment, to conduct certain types of construction work or work in the field of construction, membership in an SRO is sufficient (Article 55.8 of the Civil Code of the Russian Federation).
Thus, the list of types of work in construction - 2018, to which the SRO must provide access so that the subject of construction activity can perform them (i.e., this subject must become a member of the SRO), contains, for example, such types of work (Section III of Order No. 624 ):
- marking works for construction purposes;
- construction of temporary roads, creation of sites, engineering communications;
- work on dewatering, creation of surface runoff and drainage, etc.
Of course, this list is not complete and is provided as an example only.
Note that this list does not include the types of design, restoration, repair and construction work in relation to:
- objects for which the issuance of a construction permit is not required by law (Article 51 of the Civil Code of the Russian Federation);
- objects of individual housing construction (see also the article);
- residential buildings of blocked development, including multi-storey ones.
Types of work affecting the safety of capital construction projects, according to Art. 48.1 GK RF
In the list of types of work, approved. order No. 624, sign<*>the types of work affecting the safety of the capital construction object are noted only if they are carried out at the facilities listed in Art. 48.1 of the Civil Code of the Russian Federation. Accordingly, such work can only be carried out by entities that are members of the SRO.
For example, these jobs include:
- construction marking works;
- dismantling works, including dismantling of buildings and structures, load-bearing and auxiliary structures, other structures, elements and related elements or parts thereof;
- soil development using various mechanisms;
- soil compaction with rollers, specialized machines or heavy rammers;
- creation of heating stoves, hearths, etc.
But only when they are produced at the following facilities, classified by law as especially dangerous, technically complex and unique:
- at the facilities nuclear energy;
- hydraulic structures of I and II class;
- especially dangerous or complex communication facilities;
- objects of space or aviation infrastructure;
- railway transport infrastructure facilities;
- underground;
- seaports;
- cableways;
- hazardous production facilities (see also the article "Industrial safety review of hazardous production facilities"), etc.
Which entities do not need SRO approval in construction
We have already indicated that the membership of a construction activity entity in an SRO is not necessary in cases where the types of construction work performed are not included in a special list, approved. Order No. 624. At the same time, there is a similar exception for individual entities in the construction industry.
So, joining the SRO is not required (Article 52 of the Civil Code of the Russian Federation):
- legal entities and individual entrepreneurs (hereinafter - IP) in the performance of subcontract work;
- legal entities and individual entrepreneurs, if the cost of work under the contract is no more than 3 million rubles;
- municipal and state enterprises;
- organizations, the share of state participation in the authorized capital of which is more than 50%;
- legal entities established by public law organizations (PPO) or the share of participation of PPO in the authorized capital of which is more than 50%;
- citizens conducting construction, repair or reconstruction work in relation to an individual residential building or objects for which a building permit is not required by law, in accordance with Art. 51 of the Civil Code of the Russian Federation (as we have already said, Order No. 624 does not apply to such cases).
So, in our article, we revealed to the reader what kind of construction work requires an SRO permit. The list of types of work in construction requiring such a permit for execution was approved by order of the Ministry of Regional Development of the Russian Federation of December 30, 2009 No. 624.
Thus, the admission of the SRO (more precisely, the subject's membership in the SRO) is needed if:
- planned construction works listed, approved. order No. 624;
- the subject that will perform these types of work is not exempt from the need to obtain such a permit due to the requirements of Art. 52 GRK RF.

Question: Can a foreign company join an SRO in the construction industry without registering a branch of a foreign company with the Federal Tax Service?
Despite the fact that the Town Planning Code of the Russian Federation explicitly states that foreign legal entities (foreign companies) can join SROs of builders, designers and surveyors, and does not indicate the need to register a branch or representative office of a foreign legal entity in Russia (Art. 55.6 of the City Code - foreign companies are indicated), self-regulatory organizations, when admitted to membership, are guided by the norms of the Federal Law "On Foreign Investments in Russian Federation» dated 09.07.1999 No. 160-FZ, where in clause 3, art. 4 indicates the need for accreditation of a branch or representative office of a foreign company in Russia in order to carry out commercial activities.
We quote: “A foreign legal entity whose purpose of creation and (or) activities are of a commercial nature and which bears property liability for the obligations it has assumed in connection with the implementation of the specified activity on the territory of the Russian Federation (hereinafter referred to as the foreign legal entity), has the right to carry out activities on territory of the Russian Federation through a branch, representative office from the date of their accreditation, unless otherwise provided by federal laws. A foreign legal entity terminates its activities in the territory of the Russian Federation through a branch, representative office from the date of termination of the accreditation of the branch, representative office.
The day of accreditation of a branch, representative office of a foreign legal entity or amendments to the information contained in the state register of accredited branches, representative offices of foreign legal entities, which is information system(hereinafter also referred to as the register), or the termination of the accreditation of a branch, representative office of a foreign legal entity, the day of making the corresponding entry in the register is recognized. Question: Is it possible to return the contribution to the compensation fund?
Answer: In accordance with Part 4 of Art. 55.7 of the Town Planning Code of the Russian Federation, a person who has terminated membership in a self-regulatory organization shall not be refunded a contribution to the compensation fund, unless otherwise provided.
By "other" is meant certain cases described in Art. 3.2 Federal Law "On the Enactment of the Town Planning Code of the Russian Federation" dated December 29, 2004 No. 191-FZ 240-FZ). They inform that the construction, engineering, survey SRO is obliged to return to organizations or individual entrepreneurs that have terminated their membership in the relevant partnership, the funds they paid from the compfund, if the following conditions are met:
1) obtaining permission from this SRO for a certain type or types of work excluded on August 1, 2010 from the official list of types of work on engineering surveys, on the preparation of project documentation, on the construction, reconstruction, overhaul of capital construction facilities that affect the safety of capital construction projects construction;
2) the person’s lack of access to other types of work (lack of other types of work in the admission of the SRO);
3) termination of membership in this SRO no earlier than two and no later than 6 months from the date of exclusion of the types of work reflected in the admission from the official classifier of the list (that is, from September 1, 2010 to January 1, 2011).
It should be noted that only if all three of the above conditions are met, the self-regulatory organization is obliged to return the contributions to the compensation fund to the members that have left the membership in full.
For a return Money a period of no more than 10 calendar days after the termination of membership was allotted. The day of termination of membership is determined by the day of registration of an application from an individual entrepreneur or a legal entity to withdraw from the SRO.
Due to the fact that several years have already passed since the period of time allotted for the official termination of membership in the SRO, these grounds seem to be irrelevant.
The City Planning Code defines only a few assumptions for making payments from the compensation fund of a self-regulatory organization. Money can be returned if it was erroneously transferred to the SRO account; transferred for the placement of funds of the SRO compensation fund in order to maintain and increase it; used to make payments as a result of the onset of joint and several liability for the obligations of its members arising from the infliction of harm.

In pursuance of Part 5 of Article 8 of the Federal Law of July 22, 2008 N 148-FZ "On Amending the Town Planning Code of the Russian Federation and Certain Legislative Acts of the Russian Federation" (Sobraniye Zakonodatelstva Rossiyskoy Federatsii, 2008, N 30 (part 1), Art. .3604) and in accordance with Decree of the Government of the Russian Federation of November 19, 2008 N 864 "On measures to implement the Federal Law of July 22, 2008 N 148-FZ" On Amendments to the Town Planning Code of the Russian Federation and Certain Legislative Acts of the Russian Federation " (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2008, N 48, art. 5612),
I order:
1. Approve the attached List of types of work on engineering surveys, preparation of project documentation, construction, reconstruction, overhaul of capital construction facilities that affect the safety of capital construction facilities (hereinafter - the List).
2. Establish that the List does not include the types of work on the preparation of project documentation, on construction, reconstruction, major repairs in relation to objects for which the issuance of a building permit is not required in accordance with paragraphs 1-4, 5 of part 17 of Article 51 of the Town Planning Code of the Russian Federation (Collected Legislation of the Russian Federation, 2005, N 1, Art. 16; 2006, N 1, Art. 21; 2008, N 30, Art. 3616; 2009, N 48, Art. 5711; 2010, N 48, 6246; 2011, N 13, art. 1688; N 27, art. 3880; N 30, art. 4563, art. 4572, art. the number of floors is no more than three, intended for the residence of no more than two families); residential buildings with no more than three floors, consisting of several blocks, the number of which does not exceed ten and each of which is intended for one family, has a common wall (common walls) without openings with the neighboring block or neighboring blocks, is located on a separate land plot and has access to the common area (residential houses of blocked development); apartment buildings with the number of floors not more than three, consisting of one or more block sections, the number of which does not exceed four, each of which contains several apartments and common areas and each of which has a separate entrance with access to the common area.

The types of work on the preparation of project documentation contained in the List can be performed by an individual entrepreneur independently (personally), and the types of work on engineering surveys, construction, reconstruction, overhaul - only with the involvement of employees in the manner prescribed by the legislation of the Russian Federation (the paragraph is additionally included from December 23, 2010 by order of the Ministry of Regional Development of Russia dated June 23, 2010 N 294).
3. Recognize invalid the order of the Ministry of Regional Development of the Russian Federation dated December 9, 2008 N 274 "On approval of the List of types of work on engineering surveys, on the preparation of project documentation, on the construction, reconstruction, overhaul of capital construction facilities that affect the safety of facilities capital construction" (registered with the Ministry of Justice of Russia on January 16, 2009 N 13086), as well as the order of the Ministry of Regional Development of the Russian Federation of October 21, 2009 N 480 "On Amendments to the Order of the Ministry of Regional Development of the Russian Federation of December 9, 2008 N 274" On approval of the List of types of work on engineering surveys, on the preparation of project documentation, on the construction, reconstruction, overhaul of capital construction facilities that affect the safety of capital construction facilities "(registered in the Ministry of Justice of Russia on December 22, 2009 N 15789) from the date of entry into force of this order.
5. The control of the execution of this order shall be entrusted to the Deputy Minister of Regional Development of the Russian Federation V.A. Tokarev.
