Requirements for the conditions for the sale of fruit and vegetable products in small retail during the period of its mass receipt are set out in the sanitary rules SP 2.3.6. 1066-01 "Sanitary and epidemiological requirements for trade organizations and the turnover of food raw materials and food products”, Rules for the sale of certain types of goods, approved by the Decree of the Government of the Russian Federation of 19.01.1998 No. 55.
When selling gourds, it is mandatory to comply with sanitary requirements for the sale of food products: the object of trade must be equipped with a canopy or umbrella, the sold gourds must be stored on pedestals - storage of gourds directly on the ground is prohibited. Transportation, storage and sale of melons and gourds must be carried out in conditions that ensure the safety, quality and safety of products. The trading place, as well as the surrounding area, must be kept clean.
Products must be accompanied by documents certifying their origin, quality and safety. The consumer has the right to demand from the seller the shipping documents for familiarization.
Employees of trade organizations engaged in transportation, loading and unloading, storage and sale of melons and gourds (forwarding driver (forwarder), loader driver (loader), sellers) must have a personal medical book of the established form, which contains complete data on the results mandatory medical examination, information about past infectious diseases, a mark on the passage of hygienic training and certification. In addition, the staff must be: provided with special and sanitary clothing, neatly dressed, have a badge of the organization (name of the seller) and strictly observe the rules of personal hygiene.
Sales outlets for the sale of melons and gourds must have: a sign with full information about the name legal entity, the name of the entrepreneur, indicating the legal address, as well as the mode of operation outlet. The seller is obliged to ensure the availability of uniform and clearly defined price tags for the goods sold, indicating: the name of the product, its grade, the price per weight or unit of the product, the signature of the financially responsible person or the seal of the organization, the date the price tag was issued.
You should not buy gourds in unidentified places of trade, on the ruins along the roads, in the yards of houses. As a rule, such products do not have documents confirming their origin and safety, and the quality of such products is not guaranteed.
When buying gourds, you should pay special attention to the integrity of the surface. Before buying, carefully inspect the watermelon, melon, there should be no cracks or dents on the crust. It is strongly not recommended to purchase cut or cracked watermelons, as in this case the risk of contamination of the product with microorganisms increases dramatically. Sale of gourds in parts, with cuts to demonstrate the ripeness of the fruit is not allowed. When cutting a watermelon or melon, microorganisms from a contaminated surface get inside and multiply very quickly in a nutrient medium - sweet pulp.
Before use, gourds must be thoroughly washed under running water. Cut watermelon, melon should be stored in the refrigerator.

The sale of melons and gourds can be carried out in enterprises of a stationary and non-stationary trade network (in specialized retail and small retail trade enterprises, in specialized departments of retail trade enterprises), in markets and fairs with the organization of trading places by the type of delivery and peddling trade.

The sale of gourds in enterprises (organizations) of a retail and small-scale retail network, markets and fairs must be carried out in compliance with the requirements of the current sanitary rules SP 2.3.6.1066-01 "Sanitary and epidemiological rules for trade organizations and the circulation of food raw materials and food products in them" , Rules for the sale of certain types of goods, approved by Decree of the Government of the Russian Federation dated 01.01.2001 No. 55, including:

1. Transportation, storage and sale of gourds must be carried out in conditions that ensure the safety, quality and safety of products.

2. For the transportation of melons and gourds, only vehicles specially designed or specially equipped for the transportation of food products are used. Compliance of food storage and transportation conditions with requirements normative documents must be confirmed by the relevant entries in the shipping documents. Vehicles for the transportation of melons and gourds must be clean and in good condition. The inner surface of the car body must have a hygienic coating that can be easily washed and disinfected.

3. Circulation of gourds (transportation, storage and sale) is allowed only if there are necessary accompanying documents confirming their origin, quality and safety.

Melon crops of non-industrial production, sold at markets, fairs, are subject to sale after a sanitary and veterinary examination with the issuance of a veterinary certificate (certificate) of the established form in accordance with the established procedure, which must be presented to the buyer at his request.

4. The quality and safety of gourds must comply with the Uniform sanitary and epidemiological and hygienic requirements for goods subject to sanitary and epidemiological supervision (control), approved by the Decision of the Customs Union Commission (as amended), as well as the requirements of sanitary and epidemiological rules and regulations SanPiN 2.3 .2.1078-01 "Hygienic requirements for the safety and nutritional value of food products".

5. Employees of trade organizations engaged in transportation, loading and unloading, storage and sale of gourds (driver-forwarder (forwarder), driver-loader (loader), sellers) must have a personal medical book of the established form, in which full data are entered on the results of a mandatory medical examination, information on past infectious diseases, a mark on the passage of hygienic training and certification. In addition, the staff must be provided with special and sanitary clothing, strictly observe the rules of personal hygiene.

6. When selling melons and gourds in a non-stationary trading network operating on the principles of peddling and delivery trade, the outlet (melon breakup) must have a permit to work at the locations determined by local governments for holding fairs.

7. Spontaneous trade in melons and gourds in unorganized (unauthorized) places is prohibited.

8. The sale of gourds in a non-stationary trading network should be carried out from covered (fenced) sheds from trays, tables, carts.

Also, trade in melons and gourds from specially equipped cars is allowed. Vehicle(shops, vans). Vehicles must be properly marked, clean and in good condition.

9. It is prohibited to sell gourds from the ground, as well as their sale in parts and with cuts.

10. The trading place, as well as the surrounding area, must be kept clean.

11. Mobile vehicles of a small retail network at the end of the working day must be sanitized at the base organization.

12. It is forbidden to store mobile and portable commercial equipment and sold gourds at home from sellers.

13. The seller (owner) must have necessary premises, equipment and inventory, ensuring, in accordance with the requirements of standards, the preservation of the quality and safety of products during their storage and sale at the point of sale, proper trading conditions, as well as the possibility right choice product buyers.

14. The seller (owner) is obliged to have and maintain measuring instruments in good condition, to carry out their metrological verification in a timely manner and in the prescribed manner.

15. The seller (owner) of the outlet provides:

· acceptance and sale of gourds with documents confirming their origin, quality and safety;

Control over observance of sanitary rules and rules of trade.

16. The seller (owner) must strictly observe the rules of personal hygiene, must be neatly dressed, wear clean sanitary clothes, the badge of the organization, its name, address (location), full name of the seller.

On lawns, in the arches of buildings;

In a 50-meter zone from the perimeter of technical structures and ground vestibules of metro stations;

On the sides of the carriageway of citywide highways.

Samples of watermelons and melons must be provided with price tags drawn up in the prescribed manner with the name of the product, price per kilogram, certified by the signature of a financially responsible person or the seal of a legal entity, an individual entrepreneur, the date of registration of the price tag.

It is forbidden to sell gourds in bulk, from the ground. Sale of gourds in parts and with cuts is not allowed.

Since July 1, 2007, in connection with the introduction of amendments No. 1 to the sanitary rules SP 2.3.6.1066-01 "Sanitary and epidemiological requirements for trade organizations and the circulation of food raw materials and food products in them", the issuance of sanitary and epidemiological conclusions to trade enterprises, in including small retail trade. From May 1, 2009, Federal Law No. 294 of December 26, 2008 “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Course of State Control (Supervision)” introduced the notification nature of the beginning of entrepreneurial activity. Stationary non-store retail is subject to notification if workplace created for a period of more than one month. Retail carried out from mobile vehicles is not subject to notification.

In accordance with the Federal Law of December 29, 2009 No. 381-FZ "On the Fundamentals of State Regulation of Trading Activities in the Russian Federation", the placement of small retail trade enterprises, as well as seasonal enterprises for the sale of gourds, including issues of unauthorized trade, are within the competence of district administrations.

The basis for holding unscheduled inspection small retail trade enterprises may be the appeal of a consumer whose rights have been violated. The absence of the necessary information about the legal entity or individual entrepreneur in the application of citizens (as a rule, in these enterprises there are no signs indicating the name of the legal entity or individual entrepreneur) complicates or makes it impossible to conduct unscheduled inspections.

In view of the foregoing, the Department explains that citizens' appeals that do not contain information about the ownership of the outlet should be sent to the Administration of cities and districts of the region in order to exclude the facts of unauthorized trade.

In 2011, the Department carried out 5 raid inspections, with sampling of gourds for laboratory research. All samples of gourds, including the content of nitrates, according to radiological indicators, corresponded to hygienic standards.

At the same time, for violating the requirements of sanitary rules (the sellers did not have sanitary clothing, personal medical books), trade enterprises were brought to administrative responsibility.
