Such concern for the health of the accused, unusual for law enforcement officers, surprised the defense lawyers, especially considering that their client did not look sick at all. Nevertheless, the interrogation was interrupted, and after returning from the “medical examination” a few minutes later, Mr. Shilov thanked his defense lawyers for their work and introduced them to his new lawyer, Alexander Zheleznikov.

Recall that Sergei Shilov was originally a witness in a high-profile criminal case of abuse of power (Article 285 of the Criminal Code of the Russian Federation), committed, according to the TFR, by Andrey Nechaev, the former head of the departmental NGO Special Equipment and Communications under the Ministry of Internal Affairs of the Russian Federation. Sergey Shilov, who managed to remain in the status of a witness last fall, tried for several months to convince the investigation that the order of the Ministry of Internal Affairs was carried out impeccably by his company, but on March 1 he was placed in a pre-trial detention center and he was charged with incitement (Article 33 of the Criminal Code of the Russian Federation ) Mr. Nechaev to abuse. Detention in a criminal case on the creation of an IT system in the Ministry of Internal Affairs

As part of a criminal case on abuse during the installation of a unified intelligent system for supporting activities (ISOD) of the Ministry of Internal Affairs of the Russian Federation, the key defendant in which is the former head of NPO Special Equipment and Communications Andrey Nechaev, FSB officers detained the founder of AT Consulting Sergey Shilov. This was reported on March 1, 2018 by the Kommersant newspaper, citing its sources in the Ministry of Internal Affairs.

The investigation suspects that Shilov persuaded Andrey Nechaev, the customer of ISOD from the Ministry of Internal Affairs, to pay for work in progress worth 1.4 billion rubles.

A Kommersant source close to the investigation claims that since the fall of 2017, when a criminal case was initiated on abuse of power with grave consequences (part 3 of article 285 of the Criminal Code of the Russian Federation) when creating the ISOD, the author and designer of this system, Sergei Shilov, has been under investigation there were no questions. He was not even a witness in a criminal case. Formally, ISOD designed and assembled NIIAA, so its leaders were the first witnesses in the criminal case, the publication explains.

Citing representatives of AT Consulting, the newspaper reports that Shilov admitted that he was the main developer, installer and adjuster of the system. During the interrogation, he did not hide his old ties with the customer of the ISOD Andrei Nechaev. Both of them, before moving to the Ministry of Internal Affairs, worked in a rather narrow field of IT, and Nechaev even worked on the staff of AT Consulting for some time.

On February 28, according to Kommersant, the Main Investigative Directorate of the Investigative Committee of the Russian Federation charged Sergei Shilov with complicity in the abuse of office (Article 33 and Part 3 of Article 285 of the Criminal Code of the Russian Federation). According to investigators, the founder of AT Consulting incited Andrey Nechaev to quickly pay him off for the unfinished re-equipment of the police with modern means of communication and information security. In December, 2017 TAdviser wrote that in capital offices of AT Consulting on Bolshaya Novodmitrovskaya and 2nd Khutorskaya streets investigative actions took place. Sources of TAdviser then connected these searches with criminal case about ISOD.

The state contract for the unification of ready-made territorial and departmental networks into a single system - ISOD - worth 1.4 billion rubles was concluded in the fall of 2014. At the end of December 2014, this work was completed, accepted by the special commission of the Ministry of Internal Affairs, and Andrei Nechaev paid off the general contractor, NIIAA. Sergei Shilov refused to be released on bail of 20 million rubles and sent to a pre-trial detention center

On March 1, 2018, the day after the arrest of AT Consulting founder Sergei Shilov, the Investigative Committee secured his arrest and placement in a pre-trial detention center for two months, the Kommersant newspaper reported. The petition of the investigation for the arrest of Shilov was considered in the Basmanny Court of Moscow.

Sergei Shilov and his defense offered the court the option of releasing him on bail in the amount of 20 million rubles, but the court decision in the end turned out to be not in their favor.

The investigation believes that, remaining at large, Shilov can put pressure on his subordinates, many of whom are witnesses in the case, or hide AT Consulting documentation that is of interest to the investigation. The investigator in court argued that there had already been a precedent: during earlier searches in the company, its head allegedly gave someone the command to turn off the server.

Another argument of the investigation in favor of the arrest is that the founder of AT Consulting has real estate abroad and a valid passport. Remaining at large, he can escape, the Investigative Committee believes. The investigator's argument was also the alleged "connections of the accused in the leadership of the Ministry of Internal Affairs", which he allegedly managed to acquire during his cooperation with this department.

The investigator also noted that Sergei Shilov should not be left even under house arrest, since the accused, being a highly qualified IT specialist, will definitely find a way to circumvent injunctions and get in touch with his alleged accomplices through secret communication channels, Kommersant writes.

The defendant's lawyers in court consistently refuted all the above suspicions and called all the arguments of the investigation "spells", devoid of any documentary evidence. In their opinion, the author of the petition insists on taking the accused into custody only because it is easier to carry out “operational work” with the prisoner and exert moral pressure on him.


According to Dmitry Potapov, senior partner at AT Consulting, who has known Shilov for about 15 years, the situation looks ridiculous when, on the same day as the president’s message to the Federal Assembly, where the country’s digitalization is indicated as one of the key tasks, a decision is made to arrest Sergey Shilov under clearly far-fetched prepositions.

Confrontation with Alexei Nashchekin

On April 10, employees of the Main Investigative Directorate of the ICR, who are dealing with the case of fraud in the creation of the ISOD of the Ministry of Internal Affairs, came to the apartment of the general director of the National Telematic Systems company, Alexei Nashchekin, on Michurinsky Prospekt. By that time, Nashchekin had already been a witness in this criminal case for several months, and claims against him, apparently, arose after the operatives of the FSB of the Russian Federation found out that he was going to fly to Belarus early on Wednesday morning.

At the same time, according to a Kommersant source close to the investigation, the air ticket to Minsk was only a pretext for detention. The reason was the results of the interrogation of the co-owner of AT Consulting Sergei Shilov, arrested a month and a half ago, who is ready to conclude a pre-trial agreement with the Prosecutor General's Office. Within its framework, Mr. Shilov, who, according to the investigation, participated in the financial fraud of the customer of the ISOD Andrei Nechaev, said that the main accused had another "assistant" - the general director of NTS Alexei Nashchekin. According to Kommersant, after a four-hour interrogation on the night of April 11, Nashchekin was confronted with Sergei Shilov. During it, the detained Nashchekin insisted that he was not involved in the scam; the arrested Shilov claimed that he used his intermediary services. The investigator eventually believed Shilov and immediately after the bet charged Aleksey Nashchekin. The TFR believes that the entrepreneurs persuaded Andrey Nechaev, the chief designer of the ISOD of the Ministry of Internal Affairs, to pay for the incomplete work on the ISOD. Perhaps the representative of the Ministry of Internal Affairs did not disinterestedly meet the merchants halfway.

Nashchekin's lawyer Sergey Grivtsov considers the request of the TFR for arrest, like the entire criminal case, not "defending state interests", but "inquisitorial". According to him, the protocol of the confrontation consists of eight sheets, and on the first four Shilov stated his position, and on the rest he frankly "floated", not being able to answer the clarifying questions of Nashchekin and his defense counsel.

Release from jail

On April 20, Sergei Shilov was released from the pre-trial detention center: the Basmanny Court of Moscow changed his measure of restraint from detention to house arrest. TAdviser was told about it in the company and Shilov's lawyer Alexander Zheleznikov confirmed.

According to Zheleznikov, the period of house arrest has not yet been determined, it should become known after another court session, which will take place later.

The request to change the preventive measure was filed when the deadline for extending Shilov's detention came up. Usually it is two months. During this time, the defense of Sergei Shilov prepared arguments for the court session in order to convince the investigation and the court to release the client from the pre-trial detention center.

Alexander Zheleznikov told TAdviser that, trying to convince the court, he pointed to the facts that Sergey Shilov has young children, that he lives in Moscow and was not previously convicted.

According to the Kommersant newspaper, the process in court for a measure of restraint was short. Investigator Sergei Khudyk made a speech at it, who a month and a half ago achieved the arrest of Sergei Shilov here. This time, a representative of the Main Investigative Committee of the ICR explained to the court that Shilov had concluded a pre-trial agreement with the Prosecutor General's Office. As part of this deal, the businessman, according to the investigator, repented, "given truthful testimony in which he exposed other participants in the abuse," and confirmed his words at face-to-face confrontations with them. Thus, the need for further detention of the accused in a pre-trial detention center, according to Khudyk, has disappeared.

At the same time, the representative of the ICR explained that he could not release the person involved in the case on bail not to leave, fearing the escape of Shilov, who “has a passport and real estate abroad.” Therefore, he considers the transfer of the defendant under house arrest in his apartment on Malaya Pirogovskaya Street to be the most reasonable option, which he petitions the court for. Representatives of the Prosecutor General's Office and the protection of the businessman agreed with the author of the petition.

Minor disagreements arose between the parties only about the conditions of house arrest. Investigator Khudyk asked the court to prohibit Sergei Shilov from leaving the apartment on Pirogovka without his written permission, to use the phone and instant messengers to communicate with the outside world, and to contact journalists. In his opinion, without the sanction of the ICR, the accused could take two-hour morning walks, and call only his investigator, doctors or operational services in case of emergency. Lawyer Alexander Zheleznikov, in turn, asked the chairman of the Basmanny Court to include himself in the list of allowed subscribers, and to allow his client to walk for four hours a day instead of two.

The judge, after conferring for about ten minutes, made a decision that suited everyone: she allowed Shilov to call his lawyer freely, leaving the regime of walks proposed by the investigator in force.

Criminal proceedings

In August 2018, a criminal case was opened against Sergei Shilov under Part 5 of Article 291 of the Criminal Code of the Russian Federation (giving a bribe). Shilov's representatives focus on the fact that ISOD was commissioned in December 2014 and successfully launched in January 2015, and any claims against its creators arose only three years later. In their opinion, this indicates that the system was in a ready state at the time of acceptance.

Investigators have previously looked for a mercenary motive in the case - in particular, they assumed that Nechaev was paid some amounts through his wife. However, it was later established that Nechaev's wife was a qualified programmer and received remuneration for the work she performed.

How ISOD was built

Nechaev himself does not come from the ranks of the police, he is an IT specialist who successfully built an information and communication network for the Moscow Central Internal Affairs Directorate in the 2000s, and was subsequently involved in the creation of ISOD for the entire Ministry of Internal Affairs. As the head of the NPO “Special Equipment and Communications” subordinate to the ministry, he was responsible for installation, debugging and software for ISOD, had the right to independently contract specialists, accept work from them and make calculations.

Contract with the contractor JSC "Scientific Research Institute of Automatic Equipment named after academician V.S. Semenikhin" worth 1.4 billion rubles. Nechaev signed in the fall of 2014. According to the terms of the contract, the contractor had to combine the territorial subsystems of ISOD, the creation of which lasted two years, into the final single system. The work was accepted in December 2014, and payment was made at the same time. Launched in January 2015, ISOD is now gaining popularity among employees of the Ministry of Internal Affairs in the regions.

Purpose of ISOD

ISOD is a set of information services designed for police departments specializing in various tasks. Also, through the system, it is possible to carry out the circulation of documents within the Ministry of Internal Affairs, conduct video conferences on a federal scale, transfer data to the regions and provide public services to citizens. Users of the system note that with its introduction, data transfer began to take significantly less time, and the issuance of certificates and copies of documents to the population has also accelerated.

In a state of unavailability for work, Nechaev allegedly accepted the following components from the contractor: the Pathfinder M online system for checking suspects online, intended for operatives of the criminal investigation department, the Bridge closed communication server, through which the Ministry of Internal Affairs intended to transmit statistics to the prosecutor's office, and the base data "Modernization of IBD".

AT Consulting was founded in 2001 by Sergey Shilov. The main customers of AT Consulting remained the same: among them the Ministry of Internal Affairs, VTB, Sberbank, Rostelecom, but the amount of their contracts decreased. Some did not enter into new agreements with AT Consulting, such as Rosselkhozbank.

If cooperation with the investigation for Shilov ends with a suspended sentence, then the conviction in this case will be expunged after the expiration of the simultaneously appointed probationary period which may be shorter than the term of probation.
